Warranty

The G-10 process is unconditionally warranted against damage to the hard rubber material on any pen to which we (Giovanni Abrate and/or Richard Binder) apply the process for reblackening the pen. This warranty shall remain in force for the life of the pen and shall extend to any subsequent owners.

Should it be determined that the G-10 process has caused irreparable damage[1] to the hard rubber material on the pen, upon your providing clear proof of purchase from us, we shall replace the pen with one of the same model and similar quality. Should such comparable pen not be obtainable, you shall receive replacement costs as determined by the fair market value of such pen.

This warranty is immediately void, should another process have been applied to the hard rubber material on such pen before or after the G-10 process was applied by us.

THE ABOVE WARRANTIES ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US SHALL INCREASE THE SCOPE OF THE ABOVE WARRANTIES OR CREATE ANY NEW WARRANTIES.

REGARDLESS OF WHETHER ANY REMEDY SET FORTH HEREIN FAILS OF ITS ESSENTIAL PURPOSE, IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA ARISING OUT OF THE USE OR INABILITY TO USE THE HARD RUBBER PEN EVEN IF WE OR ANYONE ELSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.

SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.


  1. Damage shall be construed to mean any deterioration of the hard rubber material of which the pen is made that is not consistent with the natural deterioration process of such hard rubber that would occur had the G-10 process not been applied to such pen.
